Windows 10: Is it legal to a sell a PC with a free version UNactivated, no license of Windows 10 installed?

We are an OEM that mostly sell to business customers. Most of our customers have their own license agreement and would like to use their own version of Windows image. My question is, if we build our machine with an unactrivated windows system, will it violate Windows service agreement? We will of course let our customers know the Windows license is not included in our sales.

I have an electronics shop. I format used PCs and resell them. I use Windows 10 copy downloaded from Microsoft official website. In the installation process I choose "I don't have product keys" hence a watermark appears (it's the costumer duty to buy activation
key if he wishes). Is it legal to sell these PCs with such Windows version ?

It would be legal to resell a retail Windows 10 license, provided you wipe it from the machine where it is installed, but it would not be legal to resell an OEM license, which is one associated with an installation that was preinstalled by the factory,
without transferring the original hardware with it. This includes a previous version of preinstalled Windows upgraded during the free upgrade period. See Section 4, "Transfer" in the Microsoft License Agreement here:

Technically, it would be illegal, yes. Whether the legality is enforced where you live is another issue.

However, if you have a business selling computers you should be able to obtain a volume license, and sell the machines priced accordingly.

Of course you could sell the machines and have the customers pay for a Windows license themselves, but I believe you would be more

successful selling the machines if they already have a legitimate copy of Windows installed, rather than expecting people to

buy a machine with what is essentially a pirated copy and deal with that later, which could also leave you open to being blamed

for selling machine with pirated Windows.

I would hope your customers appreciate your integrity in this regard and reward you with their ongoing support.

Then again... Perhaps you will be dealing with customers who are not concerned about running an illegitimate copy of Windows

due to the extra cost involved. Your call...
