Windows 10: My pen randomly turns off with the touchscreen turning off

I have a Microsoft Surface laptop 5 i7, 16gb ram, 512gb storage and a surface pen with no clip. Whenever I use the pen on one note or any application that allows me to draw the pen would just randomly stop working with the touchscreen turning off as well. This only happens when I use the pen, the touchscreen works fine when using my fingers only. Sometimes the pen works for a while and sometimes it shuts off within seconds. I found that whenever I close my computer top to make it go to sleep, then sign back in the pen/touchscreen doesn’t work for a a couple seconds, then works again but once

On my laptop (HP Spectre x360), when I move the touchscreen pen away from my laptop screen, the screen turns black as if it were going to sleep. If it weren't so annoying I'd be impressed by how magical it is - every time the pen gets far enough away from
the screen to stop registering, the screen goes off.

I don't know if this is a Windows thing or an HP thing

EDIT: Tried the pen when laptop is in tablet mode and it does the same thing. Also does the same thing when I use my finger on the touchscreen instead of the pen

EDIT 2: I tried to delete the question but it didn't seem to let me so I'll keep this up for anyone else that might have been experiencing a similar problem; I've updated my laptop and it seems to be working fine now
